Terms and Conditions for Job Postings
Welcome, and thanks for using www.berlintopjobs.com (the “Site” or “Berlin Top Jobs”). The site is owned and operated by One Dream Team Ltd (“We”, ”Our” or “Us”) registered in Bulgaria with company number 205679564.
The information and services available on the Site are provided for the sole purpose of individuals looking for employment opportunities and career information and for employers and their representatives (“Customer(s)”) seeking to recruit staff in Berlin.
We reserve the right to amend the terms and conditions (“Terms”) from time to time without prior notice. Any changes to the Terms shall only affect new Orders (for “Job postings, Upgrades or Memberships”). “Job posting(s)”, “Job ad(s)”, “Job post(s)” and “Job submission(s)” can be used interchangeably in the Terms.
1. General submission rules
- Job submissions must be written in English and for positions in Berlin only
- Job submissions placed on the Site must be for genuine vacancies only
- No duplicating of jobs
- No over-use of keywords in job descriptions or job titles. Over-use means deliberately inserting words with the intention of influencing the job listing's position in the results listing
- URLs or e-mail links are not allowed in the body copy of the job description page
We reserve the right, in its sole discretion, to correct obvious errors or omissions and format the description of the job postings so that they are consistent with other Job posts on the Site.
2. Job postings
Berlin Top Jobs offers Free and Top Job ads to be posted in the Site’s job categories for 60 days. Depending on the type of the open position, the Customer can choose whether a post is published in the “Internships and student jobs” or the “Jobs” section within the appropriate job category (e.g. “Marketing”, “UX and Design”, etc). Published job ads are sorted by pricing type (Free and Top) and publication date. Top posts sorted by publication date appear on top of the search and category results and then Free posts sorted by publication date.
Job postings are automatically removed from the Site after 60 days of being active or after a Customer request via email.
While We may make available certain Job ads, we do not have any obligation to screen any Job ads or to include any Job ads and may exclude or remove any Job Ads from the Site for any or no reason. We cannot confirm the accuracy or completeness of any Job posting or other information submitted by any employer or other user, including the identity of such employer or other user. Berlin Top Jobs assumes no responsibility, and disclaims all liability, for the content, accuracy, completeness, legality, reliability, or availability of any Job ads.
The Customer can upgrade the Free job posts to Top for a fee equal to a new Top job post. All upgraded posts are republished on the Site for 60 days with a new publication date.
Customers can post unlimited Top Job posts within 30 days with the 30-Day Membership.
Customers can use the Membership only after the stated on the Site fee is paid and a confirmation email with the start and end date of the membership is received.
Postings submitted for review outside the 30 days between the start and end date of the membership will be considered as single postings not covered by the membership.
5. Fees, Invoicing and Payment
- All prices on the Site exclude VAT. VAT reverse charge mechanism may apply
- Payments for any Orders can be made by bank transfer, credit/debit card or PayPal
- The Customer will receive an invoice by email after the Order is reviewed by Us
- The Customer must bear all bank/third party fees for the processing of the payment. The Customer may be obliged by the regulations and conditions of the bank/third party.
- We do not grant any refunds to the Customer for any Job ads that have been removed before the expiry of the 60 day period
6. Granting of rights
The Customer grants to Berlin Top Jobs a non-exclusive, worldwide, royalty-free, sublicensable and transferable license to use, copy, store, distribute and publish the Customer materials for the purposes set forth in these Terms (including for marketing and promotional purposes).
Furthermore, the Customer grants Berlin Top Jobs a non-exclusive right, unlimited in time and territory to use the Customer's name, logos and trademarks for the purpose of listing and promoting the Customer and its Job postings on the Site and in Berlin Top Jobs' marketing materials, in press releases and as a reference or part of a portfolio for showcasing Berlin Top Jobs' services to potential investors and other customers, for example as screenshots in presentations, in pitch decks or promotion videos.
The Customer represents and warrants that he owns or have all necessary rights (including intellectual property rights) to his Job postings (including to grant the license above).
7. Governing law
The provisions of the law of Republic of Bulgaria shall apply to any cases unregulated under these Terms.
The exclusive place of jurisdiction for all matters arising out of or in connection with these Terms or its subject matter is Sofia.
